Contract creation was touching the location of the code keccak (and charging gas for it) BEFORE the contract init code was executed. This meant that if the contract creation used the
GASinstruction, it would return an incorrect value. This was found in a test, that immediately calledSELFDESTRUCTand using the outpout ofGASas its beneficiary.
