Incorrect Draw? #1

Perhaps I am missing some information here, but shouldn't a draw be declared if the two snakes hit each other head on?

Here's a screenshot where the opponent touches the side of my snake, and a draw is declared. I thought this was supposed to be a win:

I had the same issue which I submitted as #2 -- I closed that issue since my screenshot was basically identical.
