its not actually updating to latest stable?

i've had this problem occassionally where, after trying to update to the latest stable, and apparently being successful, its actually not updating at all after the reboot.
this is on an eu o3ds.

sometimes it works after a few tries, but now it hasn't worked in 10 attempts

It is a server side issue., the latest release build on the server is not the most recent one.
