due to the way basic theme is logically determined to be enabled or disabled, it only return true for basic theme being enabled if the theme name is "basic.theme". this could be solved by parsing the current applied theme's file, then looking for "IDS_THEME_DISPLAYNAME_BASIC" to determine that basic theme is selected, in order to continue applying basic theme.
